These Terms of Service ("Terms") govern your access to and use of GovRadar ("Service"), operated by GovRadar ("we", "our", or "us"). By creating an account or using the Service, you agree to these Terms.

1. Description of Service

GovRadar is a software-as-a-service platform that monitors SAM.gov for federal contract opportunities, scores them against your company profile, and generates AI-written pursuit briefs. The Service is intended for use by businesses engaged in or exploring federal government contracting.

2. Eligibility

You must be at least 18 years old and have the authority to bind the business entity you represent. By using the Service, you represent that you meet these requirements.

You must provide your own SAM.gov API key to use the opportunity ingestion features. By providing your API key, you represent that you are authorized to use it and that your use complies with SAM.gov's API terms of service. You are solely responsible for the use of your API key through our platform.

The Service uses AI (Anthropic Claude) to generate opportunity briefs. These briefs are for informational purposes only and do not constitute legal, financial, or procurement advice. GovRadar makes no representations about the accuracy, completeness, or fitness for any particular purpose of AI-generated content. You are solely responsible for all pursuit decisions made based on information provided by the Service.

8. Intellectual Property

The Service and its original content, features, and functionality are and remain the exclusive property of GovRadar. Your company profile data and watch profile configurations remain your property. You grant us a limited license to use your data solely to operate and improve the Service.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY PARTICULAR OPPORTUNITY WILL BE IDENTIFIED OR ACCURATELY ASSESSED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GOVRADAR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO GOVRADAR IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless GovRadar and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We reserve the right to suspend or terminate your account at our discretion for violation of these Terms, fraudulent activity, or for any other reason with reasonable notice. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately.

13. Governing Law

These Terms are governed by the laws of the United States and the state of Delaware, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Delaware.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or in-app notice. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
